Lender Inventory Jumps 18%</title><content type='html'>There are many problems for sellers of real estate today. Perhaps the biggest problem is the abundance of inventory from the rising number of foreclosures.  &lt;br /&gt;   &lt;br /&gt;Recent reports do not paint a better picture for distressed homeowners who must sell in the near future. According to an October 2010 article in the Wall Street Journal, lenders now have over 100 months of "shadow inventory".  &lt;br /&gt;&lt;br /&gt;100 months?&lt;br /&gt;&lt;br /&gt;Yes, 100 months! That adds up to 9 years to sell off the "Shadow Inventory" in housing right now.&lt;br /&gt;&lt;br /&gt;The most alarming thing to note is the enormous jump with inventory in just the past 3 months.  From July to September of 2010, inventory jumped almost 18%. This increase added another over 16 months of inventory to the real estate market.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;What fueled this recent jump in "shadow inventory"?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;One place to look is the groaing numbers of failed loan modifications!&lt;br /&gt;&lt;br /&gt;According to the &lt;em&gt;&lt;strong&gt;Wall Street Journal&lt;/strong&gt;&lt;/em&gt;, "&lt;em&gt;a new wave of defaults appears to be coming in, in part related to the high rate of failures on government modifications. Multiple variables indicate short sales will continue to be a frequent and important part of the mortgage industry.&lt;br /&gt;&lt;br /&gt;• Over half (55.8 percent) of all short sales occur in four states (California, Florida, Texas and Arizona).&lt;br /&gt;&lt;br /&gt;• Approximately 4 percent of short sales have a subsequent resale within 18 months.&lt;br /&gt;&lt;br /&gt;• &lt;strong&gt;Investor-driven short sales are not inherently bad. Investors provide the industry with necessary liquidity.&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;A lot of negative press lately on investor short sales so I highlighted an important point above. &lt;br /&gt;&lt;br /&gt;The Core Logic study reviews some of the current fraud concerns which includes Freddie Mac's recent "definition of fraud". And here it is:&lt;br /&gt;&lt;br /&gt;&lt;em&gt;“Any misrepresentation or deliberate omission of fact that would induce the lender, investor or insurer to agree to the terms of a short payoff that it would not approve had all facts been known.”&lt;/em&gt;&lt;br /&gt;&lt;br /&gt;The key terms to understand are "misrepresentation" or "deliberate ommission of fact".  &lt;br /&gt;&lt;br /&gt;The study uses a common example of "short sale fraud" that clearly includes a "misrepresentation AND deliberate omission of fact".  In this example the Realtor "withholds higher offers and only submits investor offer".&lt;br /&gt;&lt;br /&gt;After this example the report talks about suitable profit margins on short sale flips and an acceptable time frame.  It warns a 30% profit &lt;strong&gt;may be questionable &lt;/strong&gt;if both transaction happened on the same day.  However, as "the greater the time between transactions, the greater the reasonable margin between the two transaction amounts."&lt;br /&gt;&lt;br /&gt;Does a 30% profit on a one day short sale flip is pushing the envelope?  Possibly.&lt;br /&gt;&lt;br /&gt;However, there are suitable profit margins on one day flips that are based on an explanation from Freddie Mac Bulletin 2009-24. &lt;br /&gt;&lt;br /&gt;In this bulletin, Freddie Mac clearly distinquished between the value of distressed property and a typical retail sale. In the bulletin Freddie Mac explains "indications of property flip transactions that may be legitimate include" when the profit is a result of  "the difference in the market's reaction to distress sales and typical arms-length market sales".  &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;What does that mean?  &lt;br /&gt;&lt;br /&gt;It means there are market forces (such as lender delays with approval) that drive down the value of short sales. &lt;/strong&gt; &lt;br /&gt;&lt;br /&gt;Additionally, recent notices from lenders such as Wells Fargo acknowledge the difference.  These notices seem to indicate the suitable profit range on a short term short sale flip falls between the 5-20% above the acquisition cost.  &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;And finally the Core Logic report finishes with an important warning to lenders:&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;"Lenders must be careful not to judge all such transactions(short sale flips) the exact same way.
